Terms of Service & Refund Policy
ADR Limited | Website and online store
These terms apply to purchases and use of this website. Please read them carefully before placing an order. Nothing in these terms affects rights that cannot lawfully be excluded, including statutory consumer rights.
PART A — TERMS OF SERVICE
1. Introduction and acceptance of terms
This website is operated by ADR Limited ("ADR Limited", "we", "us" or "our"). By accessing the website or purchasing goods or services from us, you agree to these Terms of Service and the policies expressly referred to in them. If you do not agree, please do not use the website. These terms apply to visitors and customers, including businesses where applicable. Different mandatory legal protections may apply depending on whether you are acting as a consumer or in the course of business.
2. Eligibility and online store use
You must be legally capable of entering into a contract to place an order. If you allow a minor to use the website, you are responsible for ensuring that use is lawful and appropriately supervised. You must not use our products or services for unlawful or unauthorised purposes, transmit malicious code or violate applicable intellectual property laws.
3. Products, availability and descriptions
We aim to describe and display our products accurately, but screen settings may affect the appearance of colours and images. Product descriptions, availability and prices may change without notice before an order is accepted. We may limit quantities, discontinue products or restrict sales where lawful. Nothing in this section limits your statutory rights if goods do not match their description, are not of satisfactory quality or are not fit for purpose.
4. Orders, pricing and payment
Submitting an order is an offer to purchase. We may decline or cancel an order where permitted by law, including where there is a genuine pricing or stock error, suspected fraud or an inability to fulfil the order. If payment has been taken for an order we do not accept or fulfil, we will refund the relevant amount. Any additional delivery charges and the total payable should be shown during checkout before you place your order.
You agree to provide accurate billing, contact and payment information and to keep it up to date. We may apply reasonable limits to quantities ordered per person, household or order, including orders associated with the same payment method or delivery address.
5. Delivery and shipping
Delivery options, charges and estimated timescales are provided at checkout or in the applicable delivery information. Unless a different period is agreed, goods sold to consumers must ordinarily be delivered without undue delay and within 30 days of the contract being made. If delivery is delayed or goods do not arrive, your statutory rights apply. Risk in goods supplied to consumers generally passes when you, or someone you nominate other than the carrier, takes physical possession of them.
6. Cancellations, returns and refunds
Your cancellation, return, refund and exchange rights are set out in Part B below. Our voluntary returns policy is additional to, and does not replace, your legal rights. Where the law gives you a right to cancel or obtain a remedy, any conflicting restriction in our voluntary policy will not apply.
7. Customer accounts and information
You are responsible for providing accurate information and taking reasonable steps to keep account credentials secure. Personal information submitted through the store is handled under our Privacy Policy, which should be made available on the website. Payment-card information is handled through relevant payment services; we do not promise that all other internet transmissions will be encrypted.
8. Acceptable use and prohibited activities
You must not use the website or its content to break the law, infringe others’ rights, harass or discriminate, distribute malware, submit misleading information, collect others’ personal data without authority, send spam, scrape the site without permission or interfere with its security or operation. We may suspend or restrict access in response to breaches where lawful and proportionate.
9. Third-party services and external links
The website may link to independent third-party websites or provide optional third-party tools. Their content, terms and privacy practices are controlled by the relevant third parties. We do not endorse them merely by linking to them. Please review their terms before using them. Nothing here excludes liability that cannot legally be excluded.
10. Intellectual property and customer submissions
Unless otherwise stated, website text, images, branding and other materials are owned by us or licensed to us. You may use the website for lawful personal shopping purposes but may not reproduce or commercially exploit protected material without permission or another lawful basis.
If you submit reviews, suggestions or other content, you confirm that you have the necessary rights and that it is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish that content in connection with our business, subject to applicable law and our Privacy Policy. We may moderate or remove unlawful or inappropriate content.
11. Website information and accuracy
We aim to keep website information accurate and current, but general website content may contain errors or become outdated. We may correct typographical mistakes, inaccuracies or omissions. Nothing in this section permits us to avoid obligations regarding product descriptions, prices agreed in accepted contracts or other mandatory consumer protections.
12. Changes to products, services and terms
We may change or withdraw website features and update these terms by publishing a revised version. Changes will generally apply to future use and orders, not retrospectively alter an existing accepted order without a lawful basis or your agreement. Please check the website for updates.
13. Disclaimer of warranties
We do not guarantee that the website will always be available, uninterrupted or free of errors or security threats. We provide the website on an as-available basis to the extent permitted by law. This does not affect any express promises we make about products or services or any rights and guarantees that the law requires.
14. Limitation of liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing limits a consumer’s statutory remedies for faulty or misdescribed goods or services.
Subject to those protections, we are not responsible for losses that are not reasonably foreseeable when the contract is made or are not caused by our breach. If you use goods for commercial purposes, additional limitations may apply only where valid and reasonable under applicable law. We do not seek to exclude liability for our own breach of contract where doing so would be unfair or unlawful.
15. Indemnification
If you use the website in the course of business, you agree to reimburse us for reasonable, properly evidenced third-party losses and costs directly arising from your unlawful use of the website or your material breach of these terms, to the extent permitted by law. This clause does not apply to consumers in a manner that would be unfair or restrict their statutory rights.
16. Termination
You may stop using the website at any time. We may suspend or end access where there is a material breach, misuse or a lawful operational reason. Termination does not affect rights or liabilities already accrued, accepted orders that remain enforceable or provisions intended to survive termination.
17. Severability and entire agreement
If a provision is found invalid or unenforceable, the remaining provisions continue in effect so far as legally possible. These terms, together with any policies expressly incorporated into the relevant transaction, form the agreement relating to website use and purchases, subject to mandatory legal rights and any specific written terms agreed with you. A failure to enforce a right is not a waiver of it.
18. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom or another jurisdiction, you retain the benefit of mandatory consumer protections and court rights that applicable law provides.
19. Contact information
For questions about these terms or an order, email info@adrlimited.co.uk. Postal address: ADR Limited, School Bank Road, Llanrwst, Conwy, LL26 0HU, United Kingdom.
PART B — REFUND AND RETURNS POLICY
1. Your statutory rights
This policy does not affect your legal rights. Under the Consumer Rights Act 2015, consumers may be entitled to remedies where goods are faulty, not as described or not fit for purpose. These rights apply to sale items as well as full-price items. Depending on the circumstances and timing, remedies may include a short-term right to reject, repair, replacement, price reduction or refund.
2. Cancelling an online order
For most goods bought online by consumers, you have a legal right to cancel without giving a reason within 14 days after the day you (or a person you nominate) receive the goods. Some goods and contracts are exempt, including certain personalised or perishable items and sealed goods unsuitable for return for health or hygiene reasons once unsealed, where the statutory conditions are met.
To cancel, notify us clearly by email at info@adrlimited.co.uk before the cancellation period expires. You then normally have a further 14 days to send the goods back. We will refund the price paid and the cost of our least expensive standard delivery option (where applicable), within 14 days after receiving the goods back or receiving evidence that you sent them back, whichever is earlier. We may deduct for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Unless we agree otherwise or the law requires us to pay, you are responsible for the direct cost of returning goods after a change-of-mind cancellation. Any required information about return costs should be given before purchase.
3. Additional 30-day voluntary returns policy
In addition to your statutory rights, we offer a voluntary return or exchange request period of 30 days from delivery for eligible goods. For a voluntary change-of-mind return, the goods should be unused, in their original condition and packaging, with proof of purchase. Please contact us within 30 days of delivery to request instructions. This additional policy does not restrict statutory cancellation or faulty-goods rights.
Gift cards are excluded from this additional voluntary policy, but any statutory rights remain unaffected. Sale items may be excluded from the additional voluntary change-of-mind policy; this does not remove legal cancellation rights where they apply or remedies for faulty goods.
4. Faulty, damaged or incorrect goods
If an item is faulty, damaged on arrival, misdescribed or incorrect, contact us at info@adrlimited.co.uk with your order details and a description of the issue. We will assess and provide the remedy required by law. Where a return is necessary because goods do not conform to the contract, we will cover reasonable return costs as required by law. Please do not assume that the voluntary 30-day deadline applies to these claims.
5. Return process and address
Contact info@adrlimited.co.uk before sending an item so we can provide return instructions. Include your order number or proof of purchase. Send authorised returns to: ADR Limited, School Bank Road, Llanrwst, Conwy, LL26 0HU, United Kingdom. Consider using a tracked service for valuable items; tracking is a recommendation, not a condition of exercising statutory rights.
6. Refund processing
We will confirm receipt and assessment of voluntary returns by email. Approved voluntary refunds will be issued to the original payment method unless otherwise agreed, without undue delay. Statutory cancellation refunds will be made within the legal time limits described above. Your payment provider may take additional time to show the credit. If a refund appears late, check with your payment provider and then contact us.
7. Exchanges
For a voluntary exchange, contact us within the 30-day period to check eligibility and availability. If goods are faulty or not as described, your statutory rights to repair, replacement or other remedies apply independently of our voluntary exchange policy.
8. Gifts
If an order was marked as a gift and sent directly to the recipient, we may offer a gift credit for a voluntary return where agreed. If the purchaser paid for the order, refunds under statutory rights will normally be made to the original payment method unless the law or the parties’ agreement provides otherwise.
9. Return postage and shipping
For eligible voluntary change-of-mind returns outside statutory cancellation rights, you normally pay return postage, and original delivery charges are not normally refundable unless we agree otherwise. For statutory cancellations, the rules in section 2 apply. For faulty or non-conforming goods, we will meet return costs where required by law. Delivery times for exchanged products vary by destination.
